Production Deal Memo (generic)
Agreement between ‘Producer’ James Harper Willis (AKA Harper James) and Artist.
Services: Producer agrees to perform the services customarily performed by producers in the music industry and facilitate the creation of final Production Master(s)
Deliverables: Bounce of final production plus instrumental bounce unless full STEMS are built into the deal / process
Fee: Artist agrees to pay producer a flat fee (agreed upon prior). 50% due upon entering into-agreement. Remainder due within one week of first mix pass. Extra revisions to be completed after the remainder is paid.
Additional Costs: Artists will pay all outside studio recording costs (not including Harper’s production space--that’s included in the flat rate) and all payments to musicians and outside professionals involved with making of Master(s). On many projects there are no additional costs and the Producer will always ask artists before incurring any additional costs.
Writing and Publishing:
(a) Producer owns 10% of writing and publishing shares on all songs for compositional contributions unless otherwise discussed.
(b) Producer may be given additional percentage if he contributes any elements that are deemed key to the song itself (lead vocal or instrumental melody, lyrics, harmony, co-writing etc), to be negotiated in good faith.
Royalty: 3% of all gross revenue generated from exploitation of Master(s); paid by Artist to Producer every quarter or through Distrokid or another similar automatic service. (3 Points)
Mixing: Mixing is included and built into the production process. Generally the final piece of the puzzle.
Mastering: I encourage artists to hire an A list mastering engineer (recommendations can be made!) or use me. My rate for mastering is $125 a track.
Credit: Producer must be credited / tagged where applicable and/or customary (Social Media, Meta Data, Physical Products like CDs and Vinyl, allmusic.com and other similar websites)
“Produced and Mixed by Harper James” or something to that effect
By responding to this, the Artist acknowledges he or she has fully understood terms and is in full agreement.
